Why one lease signature can put your whole savings at risk

Jeonse is a lump-sum lease used almost nowhere else in the world. You pay the landlord 50 to 80 percent of a home’s value up front, then pay no monthly rent. At the end of the term, the landlord returns the full amount. If the landlord cannot pay, or the building goes to auction, that money is exposed. Deposit return insurance makes a guarantor pay you instead.

Here is the part that surprises most newcomers.

Your deposit is not held in escrow. No bank account holds it in your name. Landlords normally spend it, often on the mortgage attached to the same building, or on a deposit for a property they rent themselves. That is legal in Korea. It is also why one unpaid deposit can knock over a whole chain of them.

The Ministry of Land, Infrastructure and Transport (MOLIT) has run a nationwide victim support program since the deposit fraud wave that broke in 2023. Whole buildings turned out to be worth less than the deposits stacked inside them. Foreign tenants lost money too. Most of them had never heard of the one product that would have covered it.

The mechanism is simple. You pay a yearly premium. If your landlord fails to return the deposit within one month of the lease ending, the guarantor pays you the full amount and then goes after the landlord. You do not sue anyone. You do not wait for an auction.

Can you enroll without Korean citizenship?

Yes. Foreign nationals enroll in jeonse deposit return insurance on the same terms as Korean tenants. You need a valid Alien Registration Card (ARC), a residence report filed for the address on your lease, and a lease that clears the guarantor’s price and debt-ratio rules. Your visa class, D-2, E-7, F-6, F-4 or F-2, does not decide eligibility on its own.

The ARC is the hard requirement, not the visa. Your alien registration number does the same job a resident registration number does for Korean applicants. It appears on the policy, on the lease, and on the address record. Without it, the counter cannot open a file.

Overseas Koreans on F-4 are the common exception. Many hold a domestic residence report card instead of a standard ARC. That card works, and the residence report number is used in place of the alien registration number.

One practical point about timing. Underwriters look at whether your permitted stay covers the lease term. A one-year stay against a two-year jeonse invites questions at the counter. Bring your extension paperwork or your employment contract if your ARC expires mid-lease. Renewing the ARC later does not void the policy, but report the new number to the guarantor.

Then there is the address. Under the Immigration Act, foreign residents report a change of residence within 14 days of moving. You file at an immigration office or your local community center (jumin senteo). HiKorea is the portal for reservations and status checks, and Korea Immigration Service publishes the underlying rules.

Skip that report and the insurance application dies. So does your legal claim on the property. Here is why.

The paperwork that stops most applications at the counter

Expect to hand over six to eight items: the original lease with a fixed-date stamp (hwakjeong-ilja), bank proof that you paid the deposit, a certificate of alien registration facts, your passport, the certified copy of the property register, the building register, and the landlord’s details. Missing bank proof and a missing address report cause most rejections.

Take the two Korean documents in order.

The hwakjeong-ilja is a date stamp placed on your lease by a community center or through the online registry service. It fixes the date your claim exists. Get it the same day you sign, before you hand over the balance.

The certificate of alien registration facts is the foreigner version of a residence abstract. You can issue it at an immigration office or through Government24, which runs an English interface for civil documents. This single sheet is what stops applications more than any other item, because tenants only learn its Korean name at the counter.

Then the property side. The certified copy of the register shows every mortgage recorded against the building. Read the first page. If a bank already holds a claim larger than a third of the property value, your deposit sits behind it in line. The building register tells you something else: whether the unit is legally residential. So-called geunsaeng villas, registered as neighborhood facilities rather than housing, are refused by guarantors and fall outside tenant protection.

Under the Housing Lease Protection Act, a tenant acquires opposing power against third parties from midnight of the day following the day the tenant takes possession of the house and completes the move-in report.

That clause, published in English by MOLEG, has a sharp edge. Your protection starts the next calendar day. Documents ready. Now the choice of guarantor changes what you pay.

HUG or SGI: the choice that changes your premium

HUG, the Korea Housing and Urban Guarantee Corporation, is public and cheaper, with an annual premium near 0.115 to 0.154 percent of the deposit. SGI Seoul Guarantee Insurance is private, costs roughly 0.183 to 0.208 percent, and accepts larger deposits. Korea Housing Finance Corporation guarantees run alongside a jeonse loan. Most tenants qualify for HUG first.

Run the numbers on a 200 million won deposit. At 0.115 percent, HUG costs about 230,000 won a year. The same deposit at SGI costs closer to 370,000 won. Over a two-year lease that gap is roughly 280,000 won, which is real money and still a rounding error against the deposit itself.

Ceilings decide the rest. HUG guarantees up to 700 million won in the Seoul metropolitan area and 500 million won in other regions. SGI takes apartments with no fixed ceiling and other housing types up to about 1 billion won. If your deposit sits above the HUG line, SGI is not a preference, it is the only door. A third option, Korea Housing Finance Corporation, attaches its guarantee to a jeonse loan, so it fits tenants who borrowed to fund the deposit in the first place.

Now the practical warning for foreign applicants. Both guarantors advertise mobile enrollment. Those apps verify identity through a Korean mobile ID tied to a resident registration number, and ARC holders frequently fail that step. Plan on a branch visit or a partner bank counter, KB, Shinhan, Woori, Hana or NH, with your documents in hand. Bring a Korean-speaking friend if your reading is not strong, because the application asks about the landlord’s tax status.

Booking that visit early matters more than you would guess.

The deadline nobody mentions until it has passed

You can enroll only during the first half of the lease term. On a standard two-year jeonse, that means 12 months from the start date. Past the halfway mark, no guarantor will write the policy for that contract. You then wait for renewal and apply again in the first half of the new term.

Most tenants hear this in month 14.

A second rule catches people even inside the window. The deposit plus any senior mortgage debt must stay within 90 percent of the home’s assessed value, measured against the published price standard rather than what the agent tells you the place is worth. Tightened after the 2023 fraud cases, this rule pushes back on exactly the deals that hurt tenants: villas where the deposit nearly equals the price.

Three more conditions quietly disqualify properties. A building held in a trust registration needs the trustee’s written consent, and most trustees refuse. A property carrying a seizure or provisional attachment is out. A unit registered as a neighborhood facility rather than housing is out.

Check all of this before you pay the balance, not after. Once the money moves, your leverage is gone. So what does a clean first week look like?

Your first seven days after signing

On signing day, get the fixed-date stamp and a fresh copy of the property register. Within 14 days of moving, file the residence report. Then issue your certificate of alien registration facts, gather the bank transfer receipts, and book the guarantor visit. Aim to hold a policy within one month, not one year.

Step by step:

  1. Pull the certified property register on the day you sign and read the mortgage entries.
  2. Add a special clause banning new mortgages until the day after your move-in report.
  3. Get the hwakjeong-ilja date stamp on the original lease.
  4. Report your residence at the community center or immigration office within 14 days.
  5. Issue the certificate of alien registration facts through Government24.
  6. Save every deposit transfer receipt as a PDF, including the down payment.
  7. Apply at a HUG partner bank counter, with SGI as your fallback if the deposit exceeds the ceiling.

One last habit worth building. Set a calendar alert for six months before the lease ends, and send the landlord written notice that you will not renew.
