Korea Deposit Return: What to Do When Your Landlord Won't…

11분 읽기

The lease ended. Your deposit did not.

Your boxes are packed and the moving van is booked. Then the landlord says the money will come “once the next tenant pays.” Maybe you’re on a D-2 student visa, an E-7 work visa, or an F-6 marriage visa. Either way, tens of millions of won are now sitting in someone else’s account.

Here’s the good news. The Housing Lease Protection Act gives tenants real tools, and they apply to registered foreigners too. The bad news? One wrong move, like handing over the keys too early, can quietly weaken your claim. If you’re still unsure how your deposit type works, start with the basics of jeonse (lump-sum deposit) and wolse (monthly rent with a smaller deposit).

This guide follows the order things actually happen: the due date, your legal place in line, the court order that protects you, and what to do when the landlord stops answering.

When is the deposit return deadline in Korea, exactly?

Korean law gives your landlord no 30-day grace period. The deposit is due on the day the lease ends, at the same moment you return the home. Lawyers call this simultaneous performance under the Civil Act. If your contract ends on 31 March, the money is due on 31 March. “Waiting for the next tenant” is the landlord’s problem, not a legal excuse.

Notice decides whether the lease ends at all

A lease doesn’t end just because the date passes. Someone has to say so, in time.

Under the Housing Lease Protection Act, the landlord must announce non-renewal between 6 months and 2 months before the end date. You, the tenant, must give notice at least 2 months before the lease ends. Miss that window and silence takes over.

If neither side speaks up, the lease renews on the same terms. This is called implied renewal (mukshijeok gaengsin). The renewed lease runs for 2 years. Still, you can end an implied renewal anytime. It takes effect 3 months after the landlord receives your notice.

Put your notice in writing. KakaoTalk messages and texts count as evidence. Certified content mail (naeyong jeungmyeong) is stronger, because the post office keeps a copy and proves delivery. You can send one online through Korea Post.

Paying on time is one issue. Protecting your place in line is another. That depends on two dates most tenants never check.

Why your move-in report and fixed date matter more than the contract

Your deposit is only as safe as your priority. You gain opposing power (daehangnyeok) once you move in and register your address there. It starts at 00:00 the next day. Add a fixed date stamp to your contract and you get priority repayment if the home is auctioned. Lose either one, and other creditors can be paid before you.

Foreigners register through the immigration system

Koreans file a move-in report (jeonip singo). Foreigners do something different, but the law treats it the same way. Article 88-2 of the Immigration Act says alien registration and a report of change of residence count as a move-in report.

So report your new address within 15 days of moving. You can do this at the local community service center (jumin center), at an immigration office, or online through HiKorea. ARC address change report

The fixed date is your place in line

A fixed date (hwakjeong ilja) is an official stamp proving your contract existed on that day. Combine it with opposing power and you hold the right to tenant priority repayment. In an auction, you’re paid ahead of creditors who registered after you.

You can get one at a community service center, a registry office, or the Internet Registry Office. There’s a shortcut too. In most cities, leases with a deposit over 60 million won or monthly rent over 300,000 won must be reported within 30 days under the lease reporting system. Filing that report, through Government24 or a community service center, gives you a fixed date automatically.

Small deposits get an extra shield

Small-sum tenants get top-priority repayment (choeuseon byeonje). In Seoul, if your deposit is 165 million won or less, up to 55 million won can be paid ahead of mortgage lenders. The total is capped at half the home’s value. Other regions use lower thresholds.

These figures come from the Enforcement Decree of the Housing Lease Protection Act. They’re applied by the date the first mortgage was registered on the property, so check the current table on MOLEG.

Here’s the catch. Both shields assume you still live there with your address registered. Move out and report a new address, and your protection can drop away while the debt stays put.

So how do you leave without losing it?

How a lease registration order lets you leave and keep your rights

A lease registration order (imchagwon deunggi myeongnyeong) is a court order that writes your lease onto the property’s official register. Once the entry appears, your opposing power and priority survive even after you move out and change your address. You can file only after the lease has ended and the deposit has not been paid in full.

The rule sits in Article 3-3 of the Housing Lease Protection Act:

“If the deposit is not refunded after the lease terminates, the lessee may apply for an order of registration of the lease to the district court, the branch court of the district court, or the Si or Gun court having jurisdiction over the location of the leased house.” (Housing Lease Protection Act, Article 3-3(1), English text via MOLEG)

Lease registration order application, step by step

  1. Confirm the lease has ended. Keep your notice letter or messages. The court wants proof that the term is over.
  2. Gather documents. Bring a copy of your lease contract, the property register certificate, and proof of your registered address. For foreigners, that’s usually a certificate of alien registration facts. Add a floor plan if you rent only part of a building.
  3. File with the right court. Use the district court covering the property’s location. You can also file online through the Electronic Case Filing System, though the site is mostly in Korean.
  4. Pay the costs. Stamp duty, service fees, and registration tax usually total tens of thousands of won. Article 3-3 lets you claim these costs back from the landlord.
  5. Wait for the registry entry. Since a 2023 amendment, the order can be registered even before the landlord receives it. Landlords can no longer stall by dodging the mail.
  6. Check the register. Pull a fresh copy from the Internet Registry Office and look for the lease registration.

Only then should you hand over the keys. Do not move out until the registration actually appears on the register. Leaving one day early can cost you your original priority.

The order also puts pressure on the landlord. Under Article 3-3, a new tenant who rents a home with a registered lease gets no small-sum priority. That makes the unit harder to re-rent.

A registered lease protects your spot. It doesn’t put cash in your account. For that, you need the next set of tools.

What to do when a landlord refuses to return a deposit in Korea

Escalate in writing, then through official channels. Send certified content mail, file a lease registration order, and try mediation. If the landlord still won’t pay, a payment order or lawsuit gives you an enforceable title. With it, you can seize the landlord’s assets or force an auction of the home itself.

Step 1: Put the demand on record

Send certified content mail. State the deposit amount, the end date, your bank account, and a payment deadline. It’s not a court document. But it proves the landlord knew, and when.

Step 2: Try mediation

The Housing Lease Dispute Mediation Committee handles deposit fights. Committees operate through the Korea Legal Aid Corporation and other public bodies. It’s cheaper and faster than court. If both sides accept the settlement, it can be enforced. Korea Legal Aid also offers legal counseling through its 132 hotline.

Step 3: Ask for a payment order

A payment order (jigeup myeongnyeong) is a paper-only court process. No hearing is needed. If the landlord doesn’t object within 2 weeks of receiving it, it becomes final and enforceable. If they object, the case moves to a regular lawsuit.

Step 4: Sue for the deposit

Claims up to 30 million won go through the faster small claims track. Larger claims follow ordinary procedure. Here’s what landlords often forget. Once the complaint is served, late-payment interest jumps to 12% a year under the Act on Special Cases Concerning Expedition of Legal Proceedings.

Step 5: Enforce

With a final judgment or payment order, you can apply for a compulsory auction of the home. Your registered lease and fixed date decide where you stand in the payout line.

If you bought a deposit guarantee

Did you buy a jeonse deposit return guarantee from the Korea Housing & Urban Guarantee Corporation (HUG) or a similar insurer? Then file a claim. The insurer pays you and chases the landlord itself. Each product has its own filing conditions, so read your policy before the lease ends.

All of this assumes your lease has ended. What if you need to leave early?

Moving out before lease ends in Korea: what you can and can’t demand

During a fixed term, you have no automatic right to leave early and take your deposit. The landlord can agree, often on the condition that you find a replacement tenant. The big exception: if the lease renewed automatically or you used your renewal right, you can end it with 3 months’ notice. Then normal due-date rules apply.

The usual deal

Most early exits are negotiated. The tenant finds a new renter. The landlord returns the deposit when the new renter pays in. The departing tenant often covers the real estate agent’s fee. That last part is custom, not law, so negotiate it.

Write every agreement into a special clause (teugyak) or a signed note. Include the return date and the exact amount.

Job changes and visa endings

A new job in Busan or an expiring visa doesn’t end a lease by itself. The landlord doesn’t have to release you unless your contract says so. Think you might relocate? Ask for an early-termination clause before you sign.

If your lease already renewed by implied renewal, or you used your contract renewal right, things are easier. Your notice takes effect 3 months after the landlord receives it.

Leaving Korea before you’re paid

You can still protect yourself. After the lease ends, file the lease registration order. Then appoint a trusted person or lawyer with a power of attorney. The deposit can be paid into a Korean account or wired abroad. Ask your bank whether your account stays usable after your ARC expires.

Most of these fights are won or lost before you sign anything.

The checks that make your next deposit easier to recover

Before you sign, check who owns the home and how much debt sits on it. Read the property register, ask about the landlord’s unpaid taxes, and compare total debt plus your deposit with the home’s market value. Then register your address, get a fixed date, and consider a deposit guarantee on day one.

Your timeline from here

At least 2 months before the end date, send written notice. On the end date, hand over the keys only when the deposit arrives. If it doesn’t, stay put and file a lease registration order. Move out after the registration appears. Then push for payment through mediation, a payment order, or a lawsuit.

자주 묻는 질문

Q

Is there a legal deposit return deadline in Korea, like 30 days after moving out?

No. Under the Civil Act, returning the deposit and handing over the home happen at the same time, on the lease end date. Landlords sometimes ask for a few days to settle utility bills, but any delay should be agreed in writing. If the money doesn't arrive, secure a lease registration order before you give up the keys.

Q

Can my landlord deduct cleaning or repair costs from my deposit?

The landlord can deduct unpaid rent, unpaid utility bills, and the cost of damage beyond normal wear and tear. Normal aging, like faded wallpaper, generally isn't your cost. Ask for an itemized list with photos or receipts. If you disagree, take it to the Housing Lease Dispute Mediation Committee.

Q

Does tenant priority repayment with a fixed date work for foreigners?

Yes. Article 88-2 of the Immigration Act treats alien registration and a residence change report as a move-in report. Report your address within 15 days of moving and get a fixed date on your contract. Together they give you the same priority a Korean tenant would have.

Q

Can I complete a lease registration order application if I'm leaving Korea?

Yes, but only after the lease has ended. Many tenants appoint a lawyer or trusted person with a power of attorney to handle filing and follow-up. Online filing through the Electronic Case Filing System needs a digital certificate, which can be hard to use from abroad. Korea Legal Aid Corporation (132) can explain your options.

Q

What happens if the landlord refuses to return the deposit and stops answering?

Silence doesn't stop the process. Since the 2023 amendment, a lease registration order can be registered before the landlord receives it. A payment order or lawsuit can still proceed, and in a lawsuit the court can use service by public notice if the landlord can't be reached.
