Your deposit is not yours yet.

The boxes are packed. The lease ends tomorrow. Then the landlord walks in holding a phone camera, pointing at the mark by the light switch, the yellowed silicone in the bathroom, the scratch near the front door.

That 20-minute walkthrough decides how much of your money comes back. No government inspector attends. No standard form exists. It is a negotiation, and most foreign tenants walk into it without knowing a single rule that protects them.

What actually happens during a Korea move-out inspection?

A move-out inspection in Korea is an informal walkthrough between you and the landlord on your final lease day. No agency supervises it. The landlord checks for damage, confirms that utilities and management fees are settled, then wires your deposit. Handing over the keys and returning the deposit are treated as simultaneous obligations. Neither side has to go first.

The process starts long before that day. Under the Housing Lease Protection Act, a tenant who wants to leave at the end of the term must give notice at least two months before the expiry date. Miss that window and the lease renews on the same terms by default. Korean law calls this implied renewal. You can still exit later, but the landlord then gets three months from your notice before the deposit is due.

On the day itself, four things happen in about half an hour.

  1. The landlord or the real estate agent inspects each room.
  2. The building management office prints a final gwanribi (management fee) settlement.
  3. The city gas company reads your meter and closes the account.
  4. The deposit lands in your Korean bank account, usually by instant transfer.

Most jeonse (large lump-sum deposit, no monthly rent) and wolse (smaller deposit plus monthly rent) contracts end exactly this way. Quietly. The trouble starts when the landlord opens a photo gallery.

Here is where the first real money disappears.

Why “clean enough” means something different to your landlord

No statute sets a cleaning standard for Korean rentals. Your tenant cleaning obligation at move-out in Korea comes from your contract, not from the law. The Civil Act requires you to return the unit to its original condition, minus ordinary use. In practice, landlords expect either a receipt from a professional cleaning company or a fixed cleaning fee already written into the lease.

Check the special terms box on your contract now. Korean leases call it teugyak sahang (special agreement clause). Many contracts signed since 2020 include a line setting a move-out cleaning fee, commonly 100,000 to 300,000 won for a studio or officetel. If that clause is there, you agreed to it. If no clause exists, clean it yourself and photograph the result. The five places landlords always check:

One more trap. Furniture left behind is not a gift, it is a disposal bill. Bulky items like mattresses, desks, and sofas need a paid disposal sticker from your district office, and you can buy one online through Government24 or at the local community center. A mattress abandoned in the hallway can cost you 30,000 won or more deducted from the deposit, plus an angry building manager.

Cleaning is the easy argument. The expensive one is next.

Where does normal wear and tear end and damage begin?

The normal wear and tear definition in Korea rental law comes from the Civil Act and from court rulings, not from a published checklist. Deterioration caused by ordinary living is the owner’s cost, because it is already priced into your rent. Deterioration caused by your negligence is yours. Faded wallpaper is wear. A fist-sized hole in that wallpaper is damage.

Korean courts have held that a tenant only bears ordinary wear costs when the lease says so clearly and specifically. A vague line about restoring the property is not enough. The Ministry of Government Legislation publishes English translations of both the Civil Act and the Housing Lease Protection Act, and the Supreme Court of Korea publishes precedent summaries.

There is a second rule that saves foreign tenants real money. Under Civil Act Article 623, the landlord must keep the property in usable condition during the lease. A leaking boiler or a broken water heater is a repair the owner pays for, even if it broke while you lived there. Report those in writing when they happen, and keep the KakaoTalk thread.

So who decides which column a scratch belongs in? That is exactly the problem.

The moment most tenants lose their deposit

Most deposit losses happen because of missing evidence, not because of real damage. Korea has no formal rental damage assessment procedure with a neutral inspector. The landlord names a number, you have nothing to compare it against, and the deduction happens before the transfer arrives. Whoever holds dated photos of the move-in condition usually wins that conversation in under five minutes.

If you photographed the apartment on move-in day, open the album now and check the timestamps. If you did not, do a slow video walkthrough on move-out morning with the date visible on your phone screen. Narrate what you see. That file is your only leverage.

Two numbers matter when a landlord quotes a repair cost.

First, actual cost. A landlord cannot invent a figure. Ask for the estimate from the wallpaper or flooring company, in writing. Korean contractors give written quotes for free, and you are allowed to get your own competing quote.

Second, age. Korean courts apply depreciation to finishing materials. Wallpaper and flooring have a limited useful life, so replacing eight-year-old wallpaper is mostly a renewal the owner would have paid for anyway. You pay for the damaged portion at its depreciated value, not for a brand new apartment. Say that sentence out loud on inspection day and the number usually moves.

And when the landlord simply says no?

What to do when your landlord will not release the deposit

Landlord deposit deduction dispute rules give you three escalating options. First, keep the keys, because deposit return and surrender of the unit are simultaneous obligations. Second, file for a lease registration order at the district court before you physically leave. Third, apply to the Housing Lease Dispute Conciliation Committee, which handles deposit return and restoration cost cases for a modest filing fee.

Start with the clock. The landlord’s right to claim damage costs does not last forever.

A claim for damages caused by the manner of use of the object shall be exercised within six months from the date the object is returned. (Civil Act Article 617, applied to leases through Article 654, Korea Law Translation Center)

Six months. After that, a landlord who released your deposit cannot come back for more.

Now the tool that matters most for people leaving Korea. If your lease has ended and the deposit is unpaid, apply for a imchagwon deungi myeongnyeong (lease registration order) at the district court covering the property. Once it is registered, you keep your priority claim on the deposit even after you move out and change your address. Without it, moving out can strip the protection that the Housing Lease Protection Act gave you. Ignore one common line. Landlords often say they will pay when the next tenant is found. Legally, the obligation to return your deposit at the end of the term does not depend on a new tenant. The Ministry of Land, Infrastructure and Transport publishes the standard lease form that makes this plain.

The move-out checklist foreigners forget until the last week

A move-out condition checklist for foreigners has to cover paperwork, not just scrubbing. You need to close utility accounts in your name, cancel your internet contract, claim the long-term repair reserve if you lived in an apartment, and report your new address to immigration. The deadline for that report is 15 days from moving, under the Immigration Act.

Work through these in order.

  1. Notice, two months out. Send it in writing. A KakaoTalk message with a readable date works as evidence.
  2. Photo and video record. Move-in photos first, move-out video second.
  3. Bulky waste stickers. Buy them before the truck arrives.
  4. Final meter readings. Book the city gas closing visit about a week ahead, since technicians get busy at month end. Electricity and water are settled through the management office or KEPCO.
  5. Claim the long-term repair reserve. If you rented in an apartment complex, part of your monthly management fee was jangi suseon chungdanggeum, a building repair reserve. Under the Multi-Family Housing Management Act, that cost belongs to the owner, not the tenant. Ask the management office for a printed statement of everything you paid and bill the landlord.   6. Internet and TV contracts. Transfer rather than cancel where possible, because early termination penalties on a three-year bundle are steep.
  7. Keep the Korean bank account open until the deposit clears and any final refunds arrive.
  8. Report the address change. Bring your ARC (Alien Registration Card) and the new lease to an immigration office or your local community center. Rules and forms are on HiKorea, and the Korea Immigration Service publishes the penalty schedule for late reports.
  9. If you are leaving Korea for good, settle your NHIS premiums, check national pension lump-sum refund eligibility for your nationality, and confirm your final tax position with the National Tax Service.

Before you hand over the keys

Do three things on the morning of the inspection. Walk the unit with your phone recording. Print the settled utility and management fee receipts. Confirm your bank account number in the landlord’s phone before anyone starts talking about scratches.

Then wait for the transfer notification. Keys after money. That order is your right, not a favor.

Only for cleaning that goes beyond ordinary use, and only for a real cost the landlord can document.
